TERMS AND CONDITIONS OF AUCTION:
By bidding, the buyers are validating they agree to all the terms defined below without exception. Failure to review these terms does not allow for an exemption to the conditions set forth.
When you register for this auction, you understand and accept that ALL MERCHANDISE IS SOLD AS IS, AS FOUND CONDITION. ALL SALES ARE FINAL. THERE ARE NO REFUNDS. Please have a look at the pictures as we work hard to tell the story of each lot through them and consider them an integral part of the description. All items are of course sold where-is and as-is. We make every effort to find and note any damage, wear, defects, flaws, chips, cracks, etc. Please ask any questions prior to the closing of the auction. We are the agent of the sellers. Seller has the legal right to remove any or all items from the sale at any time for any reason. Seller has the right to a set minimum acceptable price for sale of item(s). We are not experts on arts and antiques. No guarantees are made as to condition, period or authenticity of the merchandise sold. Buyers must rely on their own knowledge when purchasing merchandise. We are not responsible for any errors or omissions. There is NO Preview for the auction. Check your item carefully and ask questions before bidding. All of these stipulations are set and protected by the state laws within which the property for sale is located. Bidders are legally bound to all terms and conditions as stipulated below once placing bids. Bidder is responsible for his/her own due diligence on any listed item(s) up for bid. Please note that Auction Firm cannot always see defects of items for description purposes. Therefore, it is imperative for all bidders to take time for preview prior to bidding. There are no refunds or returns once item is purchased. No exceptions.
ATTENTION: Acceptable payments at this time include credit/debit card, PayPal, Zelle, and Wire Transfers for exact amount of invoice only. Please note our company does not keep credit card information on file. We have opted out of requiring our buyers to have a credit card number on file with Estatesales.org in order to bid. We have also opted out of automatic charges to credit cards for immediate payment once auction is complete. Invoice must be paid in full within 48 hours of closing of last lot in auction. Please note 3% transaction fee will be charged by the three-parties like Stripe.
PICK-UP: All items are shipping available. Only some large and fragile items are available for local pick-up, incadting local pickup available. Others items without "local pickup available" mark are shipping only. Please check carefully. The pick-up is requested by the winner. Please contact us if you want to pick-up before July 25. Otherwise, we automatically think you want to ship. Any invoice must be paid before pick-up. We DON'T accept payments when you pick-up. The pick-up time is from 11 am to 3 pm (CT) on July 27th and 28th in Verona, WI 53593. The exact address will be released when you schedule with us for the pick-up. No other pick up times are available. Items not picked up within this timeframe are forfeited without refund. Please bring your boxes, support materials and assistance for pick-up.
Note for Pick Up:
This is a quiet, private estate. Park on the public road and would prefer a more seamless and streamlined pickup process. Not everyone can pull up to the house at once - know this, and come prepared! Please do not ask to come too early or arrive too late (Prefer 5-10 min before schedule time), the volume of requests is relentless - and its not possible. And we are not responsible for any injury during pickup.
SHIPPING: Everything is shipping available. A HANDLING FEE IS ADDED TO ALL ITEMS NEEDING SHIPPED! If you do not agree that we have the right to charge labor, fuel, materials, overhead, merchant fees, and sales tax on shipping services to ensure your package is ready for shipping, then please do not bid. Before bidding please be aware that our shipping charges based on weight, packing materials needed for safe transport, insurance, recipient's location, and handling fees.
Shipping is available via USPS, UPS and Professional Movers. We combine shipping if you win more than one lot. We welcome the buyers to quote the shipping cost before bidding.
IMPORTANT: Please email us within 5 business days of the close of the auction at johnyart66@gmail.com with any changes of your name and shipping address, otherwise, we are going to ship you the items using your registration information. You will receive a separate invoice for shipping informing you of the amount of your package. A HANDLING FEE IS ADDED! If you do not agree that we have the right to charge labor, fuel, materials, overhead, merchant fees, and sales tax on shipping services to ensure your package is ready for shipping, then please do not bid. The process usually takes 10 to 14 business days from last day of sale date to complete, so please be patient. We have several items we process daily, and all items are packaged in the order of queuing date.
We offer this service as a courtesy and package and ship items. The buyer agrees to pay the entire shipping cost - refusal to pay the cost will result in forfeiture of the order and no refund will be issued. No orders will be dropped off to the UPS, USPS or FedEx until the buyer pays shipping fee. We recommend that the buyer buy shipping insurance to cover the value of the items (usually the bidding price). We are not responsible for any lost, damaged, stolen or delayed conditions of shipping items. To file an insurance claim, the buyer should provide evidence and proof with the shipping carrier.
Shipping may be expensive. It MAY COST MORE THAN YOUR BID Pricing. For example, if you only win one item for $1, the shipping cost will be more than that. You are welcome to quote the shipping cost before bidding. Your package only be shipped after we receive the payment of shipping cost. At this stage, we don't cooperate with any three-party for providing shipping service.
Please beware we can only store the won items for two months after the auction. After 2 months, if we do not receive the shipping cost payment to ship the items, they will be donated or discarded without any refund.
Warranties or Guarantees: All items are sold as-is, where-is without guarantees of any kind. Auction Firm nor Seller makes any warranties or representations of any kind as to condition, function, authenticity, or description. Bidder is responsible for all due diligence. Absolutely no returns. Furthermore, Auction Firm is not liable for any omissions or mistakes in description of items for sale. Bidder is strongly encouraged to view all photographs.
Buyer Premium: A 20% premium is added to the final winning bid amount.
Third Party Platform: Auction Firm uses a third party online auction platform and is not responsible for equipment failures, software malfunctions, or accuracy of bid postings. Please contact Auction Firm if there are any issues. Please note 3% transaction fee will be charged by the three-parties like Stripe.
Bidder Obligations: All Bidders are 1) Legally bound to the terms and conditions of the sale once posting Bids; 2) Responsible for all due diligence and shipping requirements; 3) Pay items in full and take possession of items within the required time frame; 4) Provide Auction Firm with accurate and truthful information as to payment methods, emails, name, and contact information; 5) Agree to emails being added to our mailing list for future advertisement of sales or contact for issues that may arise from participating in our sales. All Bidders have right to unsubscribe from our mailing list at any time: 6) Agree that Auction Firm has the right to refuse bids, withdraw any item(s) as requested by Seller or determined by condition or function, change descriptions as necessary, group lots or divide lots as needed, create reserves for item(s), or cancel auction for any reason; 7) Bidders agree that he/she may be banned from participating from future sales, either online or live, for failure to pay invoices, participating in fraudulent activities, or providing false information.
Failure to Pay: A bidder becomes legally bound to pay for items won at auction. If bidder refuses or fails to pay, Seller has the legal right to re-sell items and pursue original bidder for any difference in loss from the second sale plus any additional costs incurred in having to have those items resold including auction and advertising fees. We encourage our bidders to pay for items won, but we also encourage our Sellers to pursue any damages from losses due to failure to pay. Additionally, bidders who fail to pay will be blocked from our future auctions and will be added to other major online auction platforms as a 'refusal to pay' bidder.

All sales are final and all items are SOLD AS IS. Bidders are strongly encouraged to ask any questions prior to bidding. Unless noted on the listing, all items are previously owned (NOT NEW). Due to limited time available during a photo shoot, there may be an imperfection not noticed. Please refer to all of the photos, as they are part of the description. We will do its best to list any damage, repairs or restorations; the absence of these descriptions or conditions must not be taken to imply that the lot is in perfect condition. Most of the items are antique, vintage or previously owned. You should expect signs of wear consistent with age and use.
