Flamingo Estate Sales Service - Auction Terms & Conditions
Bidding Starts Saturday January 25, 2025 and Ends on January 31, 2025 with a soft close starting at 3:00 PM. Preview will be on Tuesday January 28,2025 from 3:00 PM until 6:00 PM. Pick Up will be Sunday February 2, 2025 from 12:00 PM until 6:00 PM. Please be advised there is no restroom on the premises.
• Auction Overview:
This is a timed, online-only auction. A buyer’s premium of 13%, in addition to 6% Maryland sales tax, will be applied to your final invoice at the close of the auction. All items must be picked up at the designated location and within the times specified below.
• Agreement to Terms:
By participating in this auction, you acknowledge and accept the following terms and conditions, signifying your agreement to abide by the rules of Flamingo Estate Sales Service:
• You are at least 18 years old.
• You will not manipulate bids without the intent to purchase.
• You will fulfill your payment obligations for any winning bids and associated fees.
• You will not share your account or bidder information with others.
• You will not engage in fraudulent activities.
• If you are under the age of 21, you will not bid on items restricted to buyers 21 and older.
• Auction Terms:
• All items are sold as-is, where-is, with no warranties or guarantees, either expressed or implied. All sales are final.
• A winning bid constitutes a binding contract. If you cannot fulfill payment or accept the terms and fees, please refrain from bidding.
• Registration:
Bidders must pre-register with a valid credit card on file. By providing your card information, you authorize Flamingo Estate Sales Service to charge your card for the total purchase price, including the buyer’s premium and applicable taxes. You agree to maintain up-to-date payment information on your account. Registration also requires the submission of your name, address, phone number, and email address to ensure proper communication throughout the transaction. By registering, you consent to receiving future email notifications about our upcoming auctions, though you may opt-out at any time.
• Sales Tax:
All sales are subject to Maryland Sales and Use Tax. Tax-exempt buyers must provide valid exemption certificates before the end of the auction. Once validated, purchases will be exempt from tax.
• Pick-Up:
Items must be picked up within the scheduled time frame. No exceptions. Most sales are bound by strict timelines for item removal. Please bring a printed invoice for faster service. Buyers are responsible for any damage caused during the removal of items and must provide their own labor and tools (e.g., dollies, boxes). Our staff will not assist with removal.
• Shipping:
For items marked “shipping available,” shipping services are provided by a local company. Shipping costs are the buyer’s responsibility. Ensure your shipping address and contact information are current. Shipping charges will be processed through your credit card, and the shipping company will contact you directly for payment.
• Failure to Pick Up:
Failure to collect your items within the designated time does not relieve you of your financial obligations. Flamingo Estate Sales Service reserves the right to charge your card for the full amount, including any applicable taxes and fees. In such cases, we may, at our discretion, resell, dispose of, or donate uncollected items. Please be mindful there is no restroom on premises.
• Payment:
We accept Visa, MasterCard, American Express, Discover and Venmo ( Venmo payments in person only). A 3% processing fee applies. Upon completion of the auction, you will receive an invoice and have 24 hours to contact us with any payment method changes. After this period, the credit card on file will be charged.
• Bidding:
Bids must be placed in the established increments. Once placed, bids are irrevocable until the auction closes. Flamingo Estate Sales Service uses a “soft close” mechanism: if a bid is placed within the last minute of an auction, the auction time will be extended until all bids are received.
• Previewing Items:
Items can be previewed at the scheduled time for each auction. Please check the auction listing, as some may not allow previews. We strongly encourage all bidders to inspect items in person prior to bidding to assess their condition, authenticity, and other relevant factors. Please be mindful there is no restroom on premises.
• Indemnity and Liability:
By participating in this auction, you agree to indemnify and hold Flamingo Estate Sales Service, its employees, agents, and affiliates harmless from any claims, damages, or injuries arising from the purchase or removal of items. You assume full responsibility for any risks associated with these transactions.
