TERMS AND CONDITIONS OF THE AUCTION ARE AS FOLLOWS:
By registering to bid and/or placing a bid, you (“Bidderâ€) agree to be bound by all the following terms & conditions and any other announced terms and conditions of sale, and terms posted in individual item descriptions. Bidder agrees that all bids placed online have the same effect legally as if Bidder attended an in person live auction. There may be special removal terms and details listed in individual item descriptions that supersede these details.
1. Everything Sold AS-IS WHERE-IS. You (“Bidderâ€), agree that all merchandise is sold "AS-IS WHERE-IS" with no warranties express or implied and ALL SALES ARE FINAL AND THERE ARE NO REFUNDS AND NO RETURNS. All items are available for public inspection July 5, 2023 from 4:00pm - 8:00 pm. Bidders who do not attend the public inspection agree that they cannot inspect an item as well online as in person. It is the Bidder's full responsibility to determine the genuineness, condition, age, and value of any item. BJA will diligently describe each item, but makes no representations. All descriptions deemed to be reliable but not guaranteed. BJA does not guarantee any description, appraisal, grade or certification. Bidder is the sole judge of an item’s value. By placing a bid, Bidder agrees that he/she has inspected the items to his or her total satisfaction.
2. Payment. A 15% buyer’s premium applies to ALL purchases in this Auction. BJA reserves the right to charge Bidder's credit card the full amount of any or all of Bidder's bids at any time an item is won. Everything MUST be paid for in full by 5:00 PM the day after the auction. All Bidders agree to pay a buyer's premium equal to Fifteen Percent (15%) of the final price of each item Bidder purchases. If the final price of an item is $10.00, the buyer's premium will be $1.50 for a total purchase price of $11.50. Under state law, sales tax will be collected on the entire ($11.50) amount unless Bidder provides a valid resale tax license in their Bidder profile PRIOR to bidding. Bidder grants BJA the authority to charge his or her credit card on file the full amount due for Bidder's purchases or partial amounts at any time until Bidder's invoice is paid in full.
3. No Refunds, No Returns, No Chargebacks. Bidder agrees that there are no refunds, and that he or she may not return any item purchased for any reason. Bidder agrees NOT to seek a charge back.
4. Online Auction. This auction is online bidding only. Bidder acknowledges and understands that the software may or may not function correctly at any time, including during the auction closing time. Bidder agrees they have no claim of any kind against BJA or anyone else if the online auction software fails to work correctly before, during or at auction closing time. BJA will not be responsible for any missed or failed bids from any source. BJA suggests Bidders place their maximum bid 1 hour prior to the close of the sale. BJA reserves the right, in its sole discretion, to modify the closing date and times, stop, restart, withdraw or re-catalog any item in this auction, or cancel this auction. No item is considered sold until Bidder receives an invoice and Bidder has paid in full. BJA reserves the right to cancel any item or sale and resell items as deemed necessary in BJA’s sole discretion.
5. Bidding and Bidders. The bids are increased in pre-set increments set in the software and may be changed at any time in BJA's sole discretion. This online sale is public and as such, all registered bidders may bid including BJA, family members and employees.
6. Time for Removal of Items. Bring a copy of your paid receipt or have your paid receipt available on your phone. All merchandise shall be removed from the premises by Bidder at her/his own risk and expense between 1:00 PM and 5:00 PM the day following the close of the auction, Saturday, July 8th unless Bidder is paying to have BJA ship. Bidder should arrange to pick up his/her purchases within the designated pickup time. Bidder agrees that any merchandise not removed by Bidder by 5:00pm July 8th will be forfeited to BJA with no refunds. BJA has no responsibility for items left after 5:00pm the day following the close of the auction. Bidder shall have no claim to merchandise not removed by 5:00pm the day following the close of the auction.
7. Furniture and Heavy Items. Please bring help and any tools necessary to load. We do not plan to help with the loading of any furniture or heavy item.
8. Shipping. WE WILL SHIP SMALER ITEMS THAT WILL FIT IN USPS FLAT RATE BOXES OR ENVELOPES. IF YOU WANT A SMALLER ITEM SHIPPED - PLEASE MESSAGE US FOR A QUOTE - COST IS ACTUAL SHIPPING CHARGE PLUS A SMALL HANDLING FEE! Bidder agrees to confirm with BJA shipping is needed by 12:00pm the day after the close of the sale. Bidder grants BJA the right to charge Bidder’s credit card the entire amount of packing, shipping, and handling costs by BJA or a professional shipping company. All items will be insured for the purchase price. If Bidder does not pay for shipping, Bidder shall have no claim against BJA and will forfeit the merchandise with no refund.
9. Bidders. BJA, in its sole discretion may refuse to register any Bidder. BJA will block any Bidder who fails to complete a purchase. BJA may waive or modify any term of any auction for individual bidders at BJA’s sole discretion.
10. Indemnification. Bidder and his or her agents and employees specifically release and indemnify Bob Johnson Auction and Realty, Inc., bobjohnsonauctionandappraisal.com, Robert L. Johnson and all individuals representing BJA from any liability and causes of action associated with the auction public inspection, the auction or auction loadout.
11. BJA Email List. By registering for this auction, you agree to be added to BJA's email list. Each email we send has an easy unsubscribe link at the bottom of the email. Please do not report our emails as spam.
